WHAT IS IT?-It's an assisted conversation. A Mediator will guide parties through a conversation that is different than what they are used to.  The conversation gives each party an opportunity to voice their wants, needs and concerns in a controlled, systematic dialogue. Following a process allows for parties to identify and resolve issues. Following this process, the parties will brainstorm solutions that would fulfill the needs of each party. 


WHO IS MEDIATION FOR?-Anyone who is experiencing conflict and has a genuine interest in moving forward and reaching a resolution. Mediation is voluntary. Both parties have to agree to attempt mediation. Often, one party is apprehensive to try mediation. We will contact the other party to explain what mediation is, the benefits of mediation and answer any questions. Most often, both parties will agree to try mediation.

Mediation can be attempted at any point during a legal dispute.  If court documents have been filed, served or even if court dates and trials are scheduled, parties can agree to attend mediation in an effort to resolve the matter on their own terms.


BENEFITS OF MEDIATION-When parties reach an agreement together, they are more likely to stick to that agreement because it fulfills their respective needs. Often it takes only 2 sessions of mediation to settle common family law disputes, and up to 5 sessions for complex matters. Each session is scheduled for 2 hours. This saves time, energy and money for each party. Mediation can save parties thousands in legal fees.


HOW LONG DOES MEDIATION TAKE?-The answer is, it varies.  It depends on how many issues there are and how emotional the parties are at mediation. 


IMPORTANT NOTE-Mediated agreements are not Court enforceable. The agreement can be drafted into a Court Order and filed with the Court. Choice Solutions staff can prepare this documentation as well provide legal referrals for legal advice prior to entering into a Court enforceable document.


HOW MUCH DOES IT COST?- The cost for mediation sessions are often shared equally between the parties unless otherwise discussed and agreed.  Payment is required at the start of each session and no large retainer fee is required. Please call for specific costs.
